Negotiators are reportedly close to sealing a bipartisan permitting reform deal that would streamline approvals for infrastructure projects, but the legislation must clear the Senate floor before the upcoming election campaign season begins.
Capito, the Republican chair of the Environment and Public Works Committee, told Semafor the permitting bill “has to pop out of here in the next 48 hours.” Ranking member Democrat Sheldon Whitehouse said he “wouldn’t rule it out,” indicating that the Senate leadership is actively seeking a rapid vote.
The timing is complicated by a separate, high‑profile college‑sports bill that is expected to dominate Senate business all of next week. Republican leaders warn that Democratic senators, including Cory Booker and Chris Murphy, are likely to oppose or delay the sports measure, which could spill over onto the permitting agenda.
Majority Whip John Barrasso said he expects Booker and Murphy “to try to prevent it and slow us down in every possible way,” while Democratic aide AD Murphy suggested that if GOP leaders agree to amendment votes, Democrats might be willing to speed up the process.
Majority Leader John Thune also indicated that a roll‑call vote on the Ratepayer Protection Act—a data‑center power‑consumption bill introduced by Republican Jon Husted and blocked by Democrat Martin Heinrich—depends on how quickly the college‑sports and permitting bills move forward.
Whitehouse has called for a bicameral roadmap, urging Senate leaders and Speaker Mike Johnson to coordinate with the House so that any permitting reform has a clear path in both chambers. He stressed that without a joint schedule, “it doesn’t matter what we do in the Senate, now or later, if they don’t have an understanding in the House about when it gets taken up.”
With the Senate slated to go on recess on Oct. 2, leaders are racing to finish the permitting reform and other priority measures before the break, aware that lingering bills could push senators back to Washington after the election and affect their campaign calendars.
