A two‑judge First Division Bench comprising Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan rejected the petition after Advocate General Vijay Narayan presented video clips that demonstrated the amended resolution was formally put to vote by Speaker J.C.D. Prabhakar and passed unanimously without any objection from members.
The original resolution, adopted on June 19, 2026, expressed strong opposition to the Mekedatu dam project. A last‑minute amendment was later introduced, urging the Union government to constitute a tribunal under Section 4 of the Inter‑State River Water Disputes Act, 1956, to settle the inter‑state dispute.
Krishnamurthy argued that the amendment had not been debated, was inserted after most legislators had already signaled unanimous support for the unamended text, and that Chief Minister C. Joseph Vijay had agreed to the change at the request of Opposition Leader Udhayanidhi Stalin. He asked the court to quash the amended portion and restore the original resolution.
In response, Advocate General Narayan showed footage of the Leader of the Opposition requesting the amendment, the Chief Minister’s acceptance, and the Speaker’s proceeding to vote, confirming that the amendment followed proper legislative procedure and received unanimous approval.
The court’s dismissal leaves the amended resolution intact, keeping the demand for a central tribunal alive and highlighting judicial deference to the legislature’s internal processes. The inter‑state water dispute over the Mekedatu dam therefore remains unresolved pending further political dialogue.
