
Article 128 of Russia’s Labour Code requires employers to approve unpaid leave in specified family circumstances and for certain categories of workers, lawyer Alexander Yuzhalin told RIA Novosti.
Unpaid leave is generally granted by agreement between an employee and employer. But Article 128 of Russia’s Labour Code sets out situations in which an employer cannot refuse, Alexander Yuzhalin, head of legal practice at SuperJob, told RIA Novosti.
Employees receiving an old-age pension may take up to 14 calendar days of unpaid leave a year, while employees with disabilities may take up to 60 days. Employers must also grant up to five calendar days when an employee has a child, registers a marriage or loses a close relative.
In other circumstances, unpaid leave is normally subject to agreement with the employer. Yuzhalin said the law also provides for other cases in which such leave is mandatory.
