Argentine court halves labor compensation award

Labor Court No. 5 in Lomas de Zamora cut by half the compensation in a dismissal case involving a private security guard. According to La Nación, the claim originated in 2019 at 818,648 pesos. After indexation, the calculation reached 46.6 million pesos, and the court set the award at about 23.3 million.

Judges María Florencia Farina, Carina Gómez Ansede and Adriana Huguenin took part in the ruling. The court relied on its authority to moderate an excessive calculation and on the doctrine in Barrios v. Las Nieves, established by the Supreme Court of Buenos Aires province. La Nación reported that Judge Farina considered the mathematical result disproportionate to current socioeconomic conditions.

The newspaper's editorial links the dispute to the labor-payment adjustment mechanism in Article 55 of the labor modernization law. It says the formula multiplied the original amount about 57 times and presents the decision as a warning against automatic calculations. That broader assessment is the newspaper's editorial position, rather than a finding about every labor dispute.

La Nación reports that the court reduced the amount to 23.3 million pesos. A separate report by InfoGremiales gives the final award as 23,325,062 pesos and says the first-instance ruling is not yet final.
