
The defense says the case file moved between the offices of STF President Edson Fachin and Justice André Mendonça, leaving an urgent request for former banker Daniel Vorcaro’s release awaiting a decision.
The lawyers asked Fachin on Thursday to return the request to Mendonça, who had handled the Banco Master investigation before the STF president transferred the matter to his own office on September 12.
The defense first approached Fachin on September 18. According to the lawyers, the court told them to submit the urgent request to Mendonça. They contacted his office again on Wednesday and were told that Fachin had ordered the case records sent to him.
The defense’s filing says a request to return the records had been sent more than two weeks earlier and appeared to remain unanswered. The lawyers argue that the delay has left urgent applications, including the one concerning Vorcaro’s liberty, without consideration.
The filing asks Fachin to direct Mendonça, whom it describes as the case’s assigned and natural rapporteur, to rule on the pending requests. It does not mean that Vorcaro has been granted release. The CNN Brasil report says the request is still awaiting a decision.
